One of the most commonly asked questions our clients ask is whether or not they have a personal injury case. In most cases, there are 4 separate factors that will need to be met for a personal injury case to be worth pursuing. First, we must be able to prove that the defendant had some sort of duty of care toward the client; for example, in regard to car accidents, all drivers on the road have a… duty to drive safely and in accordance with the applicable traffic laws. Second, we must be able to prove that the defendant somehow breached that duty; a simple example of this would be a driver who ignores a stop sign and crashes into another vehicle. Third, we must be able to prove that the client indeed suffered some sort of injury –which could include physical, emotional, and/or financial injuries. Lastly, we must be able to connect the defendant’s actions with our client’s injuries.
